These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services provided by Cognico, LLC (“Cognico,” “we,” “us,” or “our”), including daynews.ai and other Cognico products (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Who we are

Cognico, LLC is a Delaware-registered software company that builds consumer and professional AI products for understanding, organizing, and acting on information. daynews.ai is a product operated by Cognico, and additional Cognico products may be offered under these Terms over time.

Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. If you use the Services on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us promptly of any unauthorized use.

Acceptable use

You agree not to misuse the Services. Among other things, you may not use the Services to violate any law; infringe the rights of others; upload malicious code; attempt to gain unauthorized access to our systems; or interfere with the normal operation of the Services. We may suspend or terminate access for conduct that violates these Terms.

Your content

You retain ownership of the content you submit to the Services. You grant Cognico a limited license to host, process, and display that content solely as needed to operate and improve the Services. You are responsible for the content you submit and for ensuring you have the necessary rights to it.

Subscriptions and payments

Some features of the Services may require payment. Paid plans are billed through our third-party payment processor (such as Stripe). By purchasing a paid plan, you authorize us and our payment processor to charge the applicable fees. Unless otherwise stated, subscriptions renew automatically until canceled, and fees are non-refundable except where required by law.

Intellectual property

The Services, including their software, design, and content provided by Cognico, are owned by Cognico or its licensors and are protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding without our prior written consent.

Third-party services

The Services may link to or integrate with third-party services. We are not responsible for the content, policies, or practices of those third parties, and your use of them is governed by their own terms.

Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated outputs may contain errors or omissions, and you should not rely on them as a substitute for professional advice.

Limitation of liability

To the maximum extent permitted by law, Cognico and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months preceding the claim.

Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will continue to apply.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.
